Commercial Warranty Terms and Optional Extended Warranty Terms

1. GENERAL PROVISIONS

These Terms govern:

  • the 5-year commercial warranty on the frame, which is included with the purchase of a new vehicle; and
  • the optional 3rd-year warranty for the engine and electronics, which is contracted separately and paid additionally.

These commercial warranties do not limit or exclude the consumer’s statutory rights, including rights arising from statutory conformity / legal protection.

The commercial warranty applies only to a new vehicle purchased from the Seller and applies only to manufacturing defects, under the conditions stated in this document.

2. 5YEAR FRAME WARRANTY

2.1. Duration

The frame warranty is valid for 5 years from the date of handover of the vehicle to the first Buyer.

2.2. What is Covered

The frame warranty covers:

  • the main frame / structural frame of the vehicle;
  • factory load-bearing welds on the main frame;
  • structural manufacturing defects of the main frame;
  • cracks, fractures or permanent deformations of the main frame caused by a manufacturing defect during normal use of the vehicle.

2.3. What is Not Covered

The frame warranty does not cover:

  • damage resulting from a traffic accident, fall, impact or overturning;
  • damage resulting from overloading of the vehicle;
  • corrosion, surface oxidation or aesthetic defects of paint and finish;
  • damage resulting from unauthorised welding, drilling, cutting, alterations or modifications;
  • parts that are not the main load-bearing frame of the vehicle, including accessory brackets, plastic components, metal bodywork brackets, rear box brackets, windshield brackets and similar auxiliary parts;
  • damage resulting from improper maintenance, improper storage or obvious misuse of the vehicle.

2.4. Method of Performance

If a claim is justified, the Seller may, at its own discretion:

  • carry out a repair;
  • replace the defective part; or
  • provide another reasonable technical solution.

The frame warranty does not entitle the Buyer to a cash payment, replacement of the entire vehicle or termination of the Contract, unless this follows from mandatory legal rules.

3. OPTIONAL 3RD-YEAR WARRANTY FOR ENGINE AND ELECTRONICS

3.1. Duration

The optional 3rd-year warranty applies from the expiry of 24 months from the date of handover of the vehicle until the expiry of 36 months from the date of handover of the vehicle.

3.2. Method of Contracting

This warranty is contracted separately, for an additional charge, and is shown as a separate item in the Seller’s documentation.

3.3. Price

Recommended price:

  • EUR 99, if contracted at the time of scooter purchase.

3.4. What is Covered

The optional 3rd-year warranty covers manufacturing defects affecting the following assemblies:

Engine – core internal components

  • crankshaft;
  • piston;
  • connecting rod;
  • cylinder;
  • cylinder head, if the defect results from a manufacturing defect;
  • camshaft;
  • rocker arms / valve train, if the defect results from a manufacturing defect;
  • oil pump, if the defect results from a manufacturing defect.

Electronics – core components

  • ECU;
  • injector;
  • electric fuel pump;
  • ignition coil;
  • stator;
  • regulator / regulator-rectifier;
  • electric starter / starter motor;
  • starter relay;
  • instrument cluster, if the defect results from a manufacturing defect.

3.5. What is Not Covered

The optional 3rd-year warranty does not cover:

  • battery;
  • bulbs, fuses and consumable electrical elements;
  • spark plug;
  • filters;
  • drive belt;
  • variator rollers;
  • brake pads and brake shoes;
  • tyres;
  • cables, adjustments and regular service maintenance;
  • plastic elements, paintwork, decorative and aesthetic parts;
  • failures caused by improper maintenance, delayed oil changes or improper use;
  • failures caused by incorrect fuel, unsuitable lubricants or unauthorised modifications;
  • damage caused by impact, falling, water ingress, corrosion, fire, vandalism or other external influence;
  • failures of additionally installed equipment not factory-intended or not installed / approved by the Seller.

4. GENERAL CONDITIONS FOR VALIDITY OF THE WARRANTY

The commercial warranty and the optional extended warranty apply only if all of the following conditions are met:

  • the vehicle was purchased as new from the Seller;
  • the identity of the vehicle can be verified by VIN number and sales documentation;
  • the vehicle has been maintained in accordance with the regular maintenance plan;
  • the Buyer retains invoices and/or other verifiable records of regular maintenance performed;
  • no unauthorised modifications have been made to the vehicle;
  • the vehicle has not been used in a manner that obviously exceeds its normal intended use and design limitations.

5. DEFECT / CLAIM NOTIFICATION PROCEDURE

The Buyer must:

  • report the defect to the Seller without delay, and no later than within a reasonable time from becoming aware of the defect;
  • stop further use of the vehicle if continued riding could increase the damage;
  • allow the Seller to inspect the vehicle and carry out diagnostics before repair;
  • not carry out self-repair without the Seller’s prior consent, unless this was necessary to prevent further damage and can be proven.

Before deciding on the claim, the Seller has the right to carry out inspection of the vehicle, diagnostics and verification of service history.

6. COSTS NOT COVERED

Unless the Seller expressly decides otherwise in a specific case, the commercial warranty and the optional extended warranty do not cover:

  • the cost of transporting the vehicle to the place of inspection or repair;
  • the cost of delivery or collection of the vehicle;
  • the cost of regular servicing, consumables and adjustments;
  • loss of time, loss of income, replacement vehicle or any indirect damage.

7.  TERRITORY AND PLACE OF EXERCISE

The warranty is exercised through the Seller in the territory of Montenegro, or at another place designated in writing by the Seller for inspection and handling of the claim.

8.  TRANSFERABILITY

These commercial warranties apply only to the first Buyer, unless the Seller expressly approves otherwise in writing.

9. RELATIONSHIP TO STATUTORY PROTECTION

These commercial warranties are additional benefits and do not affect the consumer’s statutory rights.
